Dear County Attorney Brown:

I am writing in regards to the upcoming contract renewal for Suffolk County’s vendor, Hunter Sports, currently operating the Suffolk County Trap and Skeet at Southaven Park. Hunter Sport’s contract is set to expire on December 31, 2015, and it is important that all stakeholders discuss the option on this contract before any future decisions regarding a contract extension are made.

As you know, since 2006 Hunter Sports and Suffolk County have been defendants in court due to the Town of Brookhaven’s efforts to enforce its noise ordinance against Hunter Sports. To date, the court has continually ruled in favor of the Town’s position that its violations can be enforced at Southaven Park.

Considering the serious impacts on the surrounding community’s quality of life, the ongoing costs of litigation being incurred by Suffolk County taxpayers and the costs of any future violations if the court continues to rule in favor of the Town of Brookhaven, the option should not be exercised without discussion on the merits of such a decision.

It’s important to note that any decision to exercise the option in Hunter Sport’s contract could lead to additional liability for Suffolk County taxpayers if Suffolk County is forced to cancel the contract early, and Hunter Sports decides to take legal action against Suffolk County. By not exercising the option the County can legally end its contract and avoid future financial burdens.

I am requesting that we meet to discuss this issue in more detail before Suffolk County moves forward. If you have any questions or concerns, please do not hesitate to contact me at 631-852-1300.

Sincerely,

 Kate Browning, Legislator
Third Legislative District
